These Website Terms of Use apply to anyone who visits or uses the iTCare website and member portal at itcareconnect.com (the Website), operated by Termatrac Pty Ltd ACN 625 513 573 (Termatrac, we, our or us). By using the Website you agree to these terms. If you do not agree, please do not use the Website.

iTCare memberships, services, payments, loan units and the Founding Member Offer are governed by the iTCare General Terms and Conditions and any offer or loan terms you accept. If there is an inconsistency, those documents apply to the matters they cover and these terms apply to use of the Website.

1. USING THE WEBSITE

1.1. Who it is for. The Website is for businesses and professionals who own or use Termatrac devices, and for people interested in iTCare. You must be at least 18 years old to create an account.

1.2. Availability. We aim to keep the Website available, but it may be unavailable at times for maintenance, updates or reasons outside our control. We may change, suspend or remove any part of the Website at any time.

1.3. Information on the Website. We take care to keep information on the Website accurate and current, but general information on public pages (including product descriptions, guides and articles) is provided as a guide only and may change. It does not replace the device instructions, your training or your own professional judgement.

2. YOUR ACCOUNT

2.1. Accurate details. When you register, you must give true, accurate and complete details about yourself and your company and keep them up to date in the member portal.

2.2. Keeping your account secure. You are responsible for keeping your password confidential and for activity under your account. Do not share your sign-in details. Tell us straight away at support@termatrac.com if you think your account has been used without permission.

2.3. Approval. Creating an account does not by itself give access to member services. Termatrac reviews each company application and may approve or decline it.

2.4. Suspension or closure. We may suspend or close an account that breaches these terms or the General Terms, gives false information, or puts the Website or other users at risk. You may ask to close your account at any time from Account settings in the member portal.

3. ACCEPTABLE USE

3.1. When using the Website you must not:

• use it for any unlawful purpose or in breach of any law;
• access, or try to access, another person's account, or parts of the Website or its systems you are not authorised to use;
• upload anything containing viruses or harmful code, or that is unlawful, offensive or infringes someone else's rights;
• interfere with the Website's operation or security, or place an unreasonable load on it, including by automated scraping, bots or repeated requests;
• impersonate any person or misrepresent your connection with a company;
• use the contact, support or registration forms to send spam or unsolicited material; or
• copy, share or resell member content in breach of section 4.

4. CONTENT AND INTELLECTUAL PROPERTY

4.1. Our content. The Website and its content, including text, images, logos, training videos and materials, examinations, documents, software and the design of certificates, are owned by or licensed to Termatrac and protected by intellectual property laws. Termatrac, iTCare and related names and logos are trade marks of Termatrac.

4.2. Your licence. You may view, download and print Website content for your own business use in connection with your Termatrac devices and iTCare membership. Member content (including training videos, training materials and examinations) is for the use of your company's registered users and trainees only. You must not copy, publish, share, sell or make it available to anyone else, or record or reproduce examinations, without our written permission.

4.3. Certificates. Certificates issued through the Website (including training, calibration, membership and Founding Member certificates) record the facts stated on them on the date issued. You must not alter a certificate, present a superseded, suspended or expired certificate as current, or use a certificate to represent that Termatrac endorses any particular inspection or report.

4.4. What you send us. You keep ownership of information and files you upload, such as support attachments. You give Termatrac permission to use them to provide iTCare services and support, as described in our Privacy Policy. You must have the right to send us anything you upload.

5. PRICES SHOWN ON THE WEBSITE

5.1. Currency. Prices are shown in Australian dollars (including GST) for Australia and New Zealand, and in US dollars elsewhere. The Website may first estimate your location from your browser to choose a currency; the currency that applies to you is set by the country of your registered company.

5.2. Estimates and quotes. Prices and calculations on public pages, including the pricing calculator, are a guide only. The price you pay is the price in the quote you accept in the member portal, on the terms shown there and in the General Terms.

5.3. Errors. If a price on the Website is clearly wrong, we may correct it before you accept a quote. This does not affect a quote you have already accepted and paid.

6. THIRD-PARTY SERVICES AND LINKS

6.1. The Website uses and links to services run by other companies, including Stripe for payments, ClassMarker for examinations, and video and webinar platforms such as YouTube, Vimeo, Canva and Zoom. Those services have their own terms and privacy policies, which apply when you use them. We are not responsible for their content or availability.

6.2. Links to other websites are provided for convenience and do not mean we endorse them.

7. TRANSLATIONS

7.1. Parts of the Website may be offered in other languages. If a translation differs from the English version, the English version applies.

8. PRIVACY

8.1. Our Privacy Policy explains how we handle personal information collected through the Website, including the cookies we use. By using the Website you acknowledge that your information will be handled as described in it.

9. LIABILITY

9.1. Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.

9.2. Use of the Website. Subject to section 9.1, the Website is provided as it is and as available. To the maximum extent permitted by law, Termatrac is not liable for any loss arising from use of, or inability to use, the Website, from reliance on general information on public pages, or from viruses or other harmful code that we could not reasonably have prevented.

9.3. Excluded loss. To the maximum extent permitted by law, Termatrac is not liable for indirect, incidental, consequential or economic loss, including loss of profits, revenue, data, opportunity or business interruption, arising from use of the Website.

9.4. Membership services. Liability for iTCare membership services is governed by clause 7 of the General Terms.

10. GENERAL

10.1. Changes. We may update these terms from time to time. The current version and its date are always shown on this page. Your continued use of the Website after a change means you accept the updated terms.

10.2. Governing law. These terms are governed by the laws of Queensland, Australia, unless mandatory laws require otherwise. Any dispute is to be resolved as set out in clause 8.2 of the General Terms.

10.3. Severability. If any part of these terms is invalid or unenforceable, the rest continues to apply.
